SECOND REPORT ON LEGAL MONITORING OF SERBIAN MEDIA SCENE

Continuing with implementation of project „ANEM and its Legal Department: Legal Monitoring of the Serbian Media Sector and Follow - up Activities”, supported by USAID and IREX Serbia, ANEM is presenting Second Report of expert team of ANEM and Law Office “Zivkovic&Samardzic”, on monitoring conducted in July 2009.

As a former one, this Report also contains a number of important data and facts, collected through legal monitoring, as well as an expert analysis and proficient opinions. Identified problematic issues and shortcomings suggest what should be revised in media legislation or practice in order to create favorable media environment.

Conducted monitoring indicates that in the field of freedom of expression, various violations of this right are still present. The period observed was especially marked by campaign of media against other media (daily Kurir and daily Glas javnosti against RTV B92) as well as by two especially interesting court rulings.

In this Report, the issue of implementation of existing laws is covered by observation regards to Broadcasting Law and   Law on Free Access to Information of Public Importance.

In the period observed, most significant changes occurred in the area of adoption of the new laws. Alterations of Public Information Law and the Draft Law on Minority Councils which Serbian Parliament should vote on August 31, 2009, are presented in full details in this report. Both drafts could be considered as the worst action of authorities toward media in this period due to non-transparence process of their preparation, suggested solutions and the consequences of their potential adoption. At the same time, Law on Media Concentration and Transparency of Media Ownership and Law on Free Access to Information of Public Importance are not yet included in the agenda of Parliament.  This way, the Establishment demonstrated the lack of proper approach toward media and that the political influence is still strong in this area.

Monitoring of relevant bodies work, comprises observation of the regulatory agencies’, authorities’ and collective societies’ activities. This Report provides for specific analyses of implementation of Government emergency measures for media assistance in crisis.

Two important media transition processes, privatization and digitalization, were also subjects of July legal monitoring and this Report. Monitoring findings confirm that the path of Serbian media reforms is still long and uncertain.

The Conclusion of this Report contains analyses and evaluation of present Serbian media situation based on performed monitoring.
