FIRST REPORT ON LEGAL MONITORING OF THE SERBIAN MEDIA SCENE

ANEM is proudly presenting the first report on monitoring for the period May-June 2009, conducted in cooperation with Law Office Zivkovic & Samardzic,  within the project entitled “ANEM and its Legal Department: Legal Monitoring of the Serbian Media Sector and Follow - up Activities”, supported by USAID and IREX Serbia. This monitoring widens the scope of ANEM advocacy activities aimed at continuation of media reforms, essential for improvement of position of media in Serbia.

Named legal monitoring implies the continuous overseeing of media regulations, work of relevant bodies, regulatory agencies and collective societies, effecting of freedom of expression, as well as the processes of privatization and digitalization, as the most influential on position of media.  Besides the mentioned, the object of monitoring will also be all other relevant media issues. Monitoring will enable more accurate mapping of all issues and problems concerning the media, as well as timely and adequate response to them. Thus it will contribute to faster solutions of all challenging issues that Serbian media are facing with. Results of monitoring and their analysis will serve as guidelines for other ANEM activities on creation of more optimal regulatory framework and more favorable environment for media functioning and development of media market in Serbia.

Based on results of monitoring, team of expert authors will further process the most important themes for media sector in observed period, and theirs articles will be presented in ANEM special publication.

Monitoring of media scene will be continually conducted, and reports with results of monitoring will be presented every month.

First in the series of reports, which is a result of monitoring of the media scene in the period from May 1st to June 30th, can be downloaded, fully or partial, with click on selected down listed section. This report consists of: 

- INTRODUCTION, with basic information about project, its goals and implementation activities;
- section FREEDOM OF EXPRESSION, with examples  of various forms of infringement or endangerment of this freedom – pressures, treats, inadequate court protection – and analysis of data collected by monitoring, and  also the state of freedom of expression in Serbia;
- section MONITORING OF THE IMPLEMENTATION OF EXISTING LEGISLATION, in which are, with general conclusion, separately processed implementations of the Broadcasting Law, the Personal Income Tax Law, The Personal Data Protection Law and the Law on Free Access to Information of Public Importance, as distinctive for observed period;
- section MONITORING OF THE PROCESS OF ADOPTION OF NEW LAWS, with results of monitoring of the process of changing existing laws and adoption of new ones, also with their legal elaboration, especially of: The Law on Illegal Media Ownership Concentration and Transparency of Public Media Ownership, the Broadcasting Law, the Advertising Law, the Criminal Code and the Law on Copyright and Related Rights;
- section MONITORING OF THE ACTIVITIES OF REGULATORY BODIES, GOVERNMENT AUTHORITIES AND COLLECTIVE SOCIETIES FOR THE PROTECTION OF COPYRIGHT AND RELATED RIGHTS, which consists of carefully analyzed activities of each named authority and organization separately, with evaluation of theirs impact on media position in Serbia;
- section  MONITORING OF THE PRIVATIZATION AND DIGITALIZATION PROCESS, which are, as the most important for continuance of democratic transition, separately evaluated through experts opinions for each one;
-section OVERALL CONCLUSION, gives analysis of media situation in Serbia in observed period, on the basis of the conducted monitoring;
